You cannot file an I-730 for your husband or wife if the marriage occurred after you become a refugee or asylee f you are a principal refugee admitted to the United States within the past 2 years, or a principal asylee who was granted asylum within the past 2 years, you may file a request for follow-to-join immigration benefits for your qualifying spouse and unmarried children under 21 years of age as a follow to join beneficiary. 

Your follow to join beneficiary is not required to have a persecution claim that would qualify them independently as an asylee or refugee; rather, they derive that status through their relationship to you. Your spouse/child does not have to be the same nationality as you. 

However, all follow to join beneficiaries must be able to provide proof of the qualifying relationship.

When can I file my I-730 Petition for my relative(s)? 

You have two years to file form I-730 for your family members from the date you received your Refugee or Asylee status. In limited circumstances USCIS may waive this requirement.

What if married my spouse after I became a Refugee or Asylee?
