Application to Register Permanent Residence or Adjust Status is filed when the individual is in the U.S. in a qualifying category with a valid status. What is the filing fee for the I-485? [Fees to go up April 1, 2024]

 

When can I file my I-485 Petition? 

In many cases it can be filed concurrently with an I-130 or I-140 or other Petitions, however if you are reading this section this means you already have something approved your I-485 is based upon. You can file anytime when you have a pending or approved Petition and no Visa wait time. 

Do I have to have a Civil Surgeon Medical completed before filing? 

Prior to the update to the rules [Please read about the rule updates on Julianne’s Blog.] a lot of attorneys, were holding off on submitting these with the I-485 filing due to expiration that cost their clients money by needing to have them redone.  However, with current laws it is absolutely recommend you have this done just before you file your I-485, and file it concurrently with your I-485. To not do so will likely add unnecessary timely delays to processing of your I-485.

Do I need to hire an attorney to file my I-485 Petition? 

No! You can apply without an attorney.  However, many applicants run into issues by making simple mistakes, or not understanding how a wide range of topics may impact an application.
